    Important Provisions under the Senior Citizens Act

    • The Act provides for the maintenance expenses of senior citizens by their children.
    • As per Section 2 of the Act, “children” include sons, daughters, grandsons, and granddaughters related by blood to the senior citizen.
    • Individuals aged 60 years or above are referred to as ‘senior citizens.’
    • According to Section 4(1), senior citizens who cannot maintain themselves from their own income or property can apply for maintenance/allowance under Section 5 to the Assistant Commissioner of Social Welfare of the concerned district or the Sub-Divisional Officer (Revenue) and Chairman of the Senior Citizens Tribunal of the concerned district.
    • Section 7 establishes a “Tribunal” for each sub-division to handle complaints regarding maintenance/allowance.
    • The Sub-Divisional Officer (Revenue) is appointed as the ‘Presiding Officer’ for each division.
    • Applications received under Section 8 are heard and decided by the Senior Citizens Tribunal.
    • Section 9 allows the Tribunal to pass orders for the maintenance amount as deemed appropriate.
    • As per Section 9(2), the maintenance amount from children shall not exceed Rs. 10,000/-.
    • Section 12 allows for appeals against the orders of the Tribunal to the ‘Appellate Authority,’ which is the ‘District Magistrate’ of the concerned district.
    • If dissatisfied with the Tribunal’s order, appeals can be filed with the ‘Appellate Authority’ under Section 16(1).
    • Section 18(1) designates the Assistant Commissioner of Social Welfare of the concerned district as the ‘Maintenance Officer.’
    • The government has enacted rules through a notification dated 23 June 2010 for the implementation of the Act. Cases filed under this Act are processed as per the provisions of the Act and rules.
    • The Act provides for imprisonment up to 3 months and/or a fine up to Rs. 5,000/- for children who fail to maintain their parents.
    • Offenses under the Act are cognizable.
